Description
CONTESTED DIVORCE
In a contested divorce, there is at least one issue over which the parties disagree. The issue could be custody of the children or division of assets, just to name a few. If the disagreement can’t be settled outside of Court, then a Judge will ultimately make a decision and enter a ruling on any contested issues.
UNCONTESTED DIVORCE
In an uncontested divorce, there are no issues in dispute. In this situation, the parties just want to be divorced and they have been physically separated for over one (1) year before filing OR a Marital Separation Agreement has been signed and notarized. If all assets have been divided or an agreement has been reached on how to divide the assets, any issues on custody, access, and child support have been determined and agreed to by the parties, and alimony has been agreed upon or waived, then the case is uncontested. At that point, the Court proceeding is streamlined, as no issues are being contested.
